App., No. 03CA0072 (5/6/04): The Colorado trial court erred in holding that it lacked jurisdiction to enter a judgment against the mother for overpaid child support due to a Colorado order granting retroactive support. While the trial court stated it lacked jurisdiction, the appellate court pointed out that a support order under the UIFSA is defined as including an order for "reimbursement." The opinion stated that the overpayment should be credited against his future support obligation only if "the interest of the children would not be harmed." |

In re Haddad, Colo. Ct. App., No. 03CA0072 (5/6/04): The Colorado trial court erred in holding that it lacked jurisdiction to enter a judgment against the mother for overpaid child support due to a Colorado order granting retroactive support. While the trial court stated it lacked jurisdiction, the appellate court pointed out that a support order under the UIFSA is defined as including an order for "reimbursement." The opinion stated that the overpayment should be credited against his future support obligation only if "the interest of the children would not be harmed." |
