In re Haddad, Colo. Ct. App., No. 03CA0072 (5/6/04):  The Colorado trial court erred in holding that it lacked jurisdiction to enter a judgment against the mother for overpaid child support due to a Colorado order granting retroactive support.  While the trial court stated it lacked jurisdiction, the appellate court pointed out that a support order under the UIFSA is defined as including an order for "reimbursement."  The opinion stated that the overpayment should be credited against his future support obligation only if "the interest of the children would not be harmed."

Grumme v. Gumme, 5/7/04 (Miss. Ct. App. 2004): The trial court erred in ruling that the Mississippi court lacked jurisdiction under UIFSA to register, enforce and modify a Guam support decree where the ex-husband was a service-member who resided in Mississippi.  The divorce decree provided that jurisdiction over future issues would be in the country where the mother and child resided and the mother had moved to England.  The appellate court held that the trial court mistakenly applied a Mississippi case decided under the UCCJA.

In re Haddad, Colo. Ct. App., No. 03CA0072 (5/6/04):  The Colorado trial court erred in holding that it lacked jurisdiction to enter a judgment against the mother for overpaid child support due to a Colorado order granting retroactive support.  While the trial court stated it lacked jurisdiction, the appellate court pointed out that a support order under the UIFSA is defined as including an order for "reimbursement."  The opinion stated that the overpayment should be credited against his future support obligation only if "the interest of the children would not be harmed."
